Munchkin's Project Pink Decorating Contest
OFFICIAL RULES
THE MUNCHKIN CONSUMER CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA.
How It Works:
Munchkin invites you to submit an original photograph of a fully decorated limited edition pink White Hot Safety Bath Ducky. Your entry will be judged on the creativity of your decorating skills so the limited edition pink duck(s) must be decorated in order for your photograph to qualify for the contest. The Project Pink Decorating Contest is sponsored by Munchkin Inc. ("Sponsor") and is open to all photographers at least 18 years of age, except for employees of Sponsor and their immediate families.
Here's How To Enter:
Log on to www.munchkin.com between 12:01 a.m. PST on 8/3/07 and 11:59 p.m. PST on 10/31/07 and follow on-screen instructions to register, complete a quick entry form, and upload your pink duck photo. All online entrants must have a valid e-mail address. In case of dispute as to identity of the winner who enters online, entry will be declared by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user.
Entrants may enter more than once but each entry must be uniquely decorated and follow the requirements listed or entry will be disqualified. All photo entries become the property of Munchkin Inc.
Entries must meet all of the following requirements or they will be disqualified:
- All entries must include a pink limited edition 2007 Munchkin White Hot Safety Bath Ducky, from which $.20 or 100% net proceeds (whichever is greater) benefit Susan G. Komen for the Cure. The duck can be purchased starting August 2, 2007 on www.munchkin.com or at major retailers beginning in mid-September 2007.
- Each entry must be uploaded to the Munchkin Web site (www.munchkin.com) by 10/31/07 at 11:59 p.m. PST to be eligible to win.
- All entries must be uploaded in a JPEG format in 72 DPI or greater.
- Each entry must be original, unpublished, the sole property of submitter, and not previously submitted in any other contest and may not infringe upon any third party rights.
- Each entry must include: entrant's full name, street address, city, state, zip code, phone number and email address.
- At Sponsor's discretion, entries including unsuitable content or that are in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified.
Prizes:
One (1) grand prize winner will receive a housecleaner once a month for 12 months and a Munchkin gift basket. Total prize package ARV up to $1,800. Monthly services must be executed in consecutive months and conclude by December 31, 2008.
One (1) second place winner will receive a $500 gift certificate to a local spa. Spa services to be scheduled by December 31, 2008. Winner will also receive a Munchkin gift basket (AVR $150)
One (1) third place winner will receive a Munchkin gift basket (ARV $150). Winner will receive the basket via mail by December 31, 2007.
If a winner is unable to have prize services performed by dates stated, prize will be forfeited. Cash substitutions for prizes will be permitted solely at the discretion of the Sponsor. Prizes are non-refundable and non-transferable except at sole discretion of sponsor. Odds of winning depend upon the number of eligible entries received. Munchkin reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner. Total ARV for all prizes is $2,600.
Winner selection:
A grand prize winner, second place winner and third place winner will be chosen by a panel of judges selected by the Sponsor. All judging will be based on the following criteria: overall appearance and originality - 33%, creativity - 34% and level/complexity of decoration - 33%. In the event of a tie, tiebreaker will be based on the highest score for "creativity." Winners will be notified by phone, postal mail and/or email on or about 11/31/07.
By entering the Contest, entrants accept and agree to these rules. Winners will be required to sign a Winner's Agreement and Release and return it by date specified in notification letter or prize will be forfeited in its entirety and another winner may be selected. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected.
By submitting an entry, entrant agrees to allow use of his or her name and entry for advertising and promoting this or similar promotions, including posting of their first name and last initial on the Web site, without compensation unless prohibited. Entrant also agrees and acknowledges that Sponsor may edit and publish/post the entry prior to use, and that the entry is entrant's original work, and that Sponsor's use will not violate any third party's rights. All entries and all rights of ownership and publication of same will become the property of Sponsor and will not be returned.
The limited edition pink White Hot Safety Bath Duck is not intended for use in the bath or by children if altered or decorated. Keep all decorating materials out of reach of children both before and after they may be used on the duck. Sponsor is not liable for any harm caused by the use of hazardous materials, including but not limited to choking and ingestion of hazardous materials in connection with this contest.
Other Conditions:
Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest by any technical or human errors which may occur in the processing of the entries in the Contest. Sponsor reserves the right to cancel or withdraw from this Contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or web-site or to be acting in violation of the Rules. Munchkin Inc., and its affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize or prizes. Void where prohibited or restricted by law. Subject to all federal, state and local laws.
